Crown wants 4 months jailtime for rioter

VANCOUVER (NEWS1130) – Crown is asking for a second rioter on trial to spend 4 months behind bars.

They want Emmanuel Alviar to be sentenced for more than just what he did the night of June 15th.

Alviar has pleaded guilty to participating in a riot. At a sentencing hearing today, the Crown has presented a timeline with pictures and video clips of his actions.

Video footage in court showed the 19-year-old man posing for pictures in front of a burning truck, pushing a damaged car and throwing part of a barricade at a Telus window. Crown says those crimes are inextricably linked to the overall outcome of the riot – the damage to businesses, the city and the people who live here.

Not only was he involved for several hours, in 3 different locations, but he arrived only at the end of the game to see what would break out and he brought four 14 year olds with him. Also he chose to stay and participate in the violence, which crown says shows more than a momentary lapse in judgement.

Much of the video was not of Alviar himself, but rather the “lawlessness” of the riot as Crown tried to give context of what Alviar contributed to.

The 4 months crown wants is less than the sentence of the first rioter, Ryan Dickinson, but Alviar has no prior problems with the law. Crown is not asking for restitution but are asking for 50-100 hours of community service.
