Michael Rafferty will not take the stand in his own defence.  

The 31-year-old is on trial, accused of killing 8-year-old Tori Stafford.  

He has pleaded not guilty to first degree murder, sexual assault causing bodily harm, and kidnapping.

The Crown wrapped up its case last week.

The trial has heard conflicting evidence from Rafferty’s ex-girlfriend Terri-Lynne McClintic, who pleaded guilty two years ago to first-degree murder. McClintic has previously said Rafferty killed Tori, but now says it was her.

The Crown has told the jury it is not necessary for them to determine who exactly did what, but whether Rafferty and McClintic acted together to bring about the girl’s death.
